2013年8月7日，司法部發(fā)布《司法部關(guān)于修改〈取得內(nèi)地法律職業(yè)資格的香港特別行政區(qū)和澳門特別行政區(qū)居民在內(nèi)地從事律師職業(yè)管理辦法〉的決定》（《決定》），自2013年10月1日起施行。
《決定》將《取得內(nèi)地法律職業(yè)資格的香港特別行政區(qū)和澳門特別行政區(qū)居民在內(nèi)地從事律師職業(yè)管理辦法》（《辦法》）的第四條修改為：“取得內(nèi)地律師執(zhí)業(yè)證的香港、澳門居民在內(nèi)地律師事務(wù)所執(zhí)業(yè)，可以從事內(nèi)地非訴訟法律事務(wù)，可以代理涉港澳民事案件，代理涉港澳民事案件的范圍由司法部以公告方式作出規(guī)定。取得內(nèi)地律師執(zhí)業(yè)證的香港、澳門居民在內(nèi)地從事涉港澳民事案件的代理活動應(yīng)當(dāng)依據(jù)有關(guān)具體規(guī)定辦理。”此外，《決定》還對《辦法》的第八條、第十五條作了修改。（來源：司法部）
Ministry of Justice Releases Decision of Ministry of Justice on Revising the Administrative Measures for Residents from Hong Kong Special Administrative Region or Macau Special Administrative Region Possessing Mainland's Legal Profession Qualification who Engage in Legal Profession in Mainland
On August 7, 2013, the Ministry of Justice released the Decision of the Ministry of Justice on Revising the Administrative Measures for Residents from the Hong Kong Special Administrative Region or Macau Special Administrative Region Possessing Mainland’s Legal Profession Qualification who Engage in Legal Profession in the Mainland (the "Decision"), effective as of October 1, 2013.
According to the Decision, Article 4 of the Administrative Measures for Residents from Hong Kong Special Administrative Region or Macau Special Administrative Region Possessing Mainland’s Legal Profession Qualification who Engage in Legal Profession in the Mainland (the "Measures") is revised as: "Any resident from Hong Kong Special Administrative Region or Macau Special Administrative Region possessing Mainland’s legal profession qualification who practices in a law firm in the Mainland may engage in non-litigation matters in the Mainland, or may represent in Hong Kong or Macau-related civil cases. The scope of Hong Kong or Macau-related civil cases permitted to be represented by such resident is determined through an announcement of the MOJ. Any resident from Hong Kong Special Administrative Region or Macau Special Administrative Region possessing Mainland’s legal profession qualification shall represent in Hong Kong or Macau-related civil cases in the Mainland according to relevant specific provisions."
